ΑΝΑΚΟΙΝΩΣΗ ΤΥΠΟΥ

Θέμα:  Σύσκεψη και συμπεράσματα Ειδικής Επιτροπής περί Προστασίας της Ακίνητης Περιουσίας του Γενικού Συμβουλίου ΔΕΕΕΜ ΟΜΟΝΟΙΑΣ. Αποφασιστικότητα για κινητοποίηση κοινοτήτων και δυναμικού της ΕΕΜ για την καταγγελία και μέτρα αποτροπής τετελεσμένων.

Συνεδρίασε χθες, Δευτέρα, 24 Φεβρουαρίου 2020 στη Δερβιτσάνη, υπό την προεδρία του Προέδρου της Οργάνωσης και με συμμετοχή και των Προέδρων στα Παραρτήματα, η Ειδική Επιτροπή περί Προστασίας της Ακίνητης Περιουσίας μελών και κοινοτήτων της ΕΕΜ, του Γενικού Συμβουλίου. Παραβρέθηκε και τοποθετήθηκε ο Πρόεδρος της Ένωσης για Ανθρώπινα Δικαιώματα – ΚΕΑΔ  κ. Βαγγέλης Ντούλες. 

Η Επιτροπή εξέτασε όλες τις παραμέτρους του σύνθετου αυτού ζητήματος, ζωτικής σημασίας για το παρόν και το μέλλον της ΕΕΜ. Χρόνιες σκόπιμες πρακτικές των κρατικών αρχών έχουν δημιουργήσει μια ιδιαίτερα ανησυχητική κατάσταση αναγνωρίζοντας αφενός ιδιοκτησίες με πλαστογραφημένα και άλλες λαθροχειρίες έγγραφα σε κοινότητες και δημόσιες περιουσίες στο χώρο όπου ιστορικά και σε σημαντικούς αριθμούς ζεις ο γηγενής Ελληνισμός.

Επιπροσθέτως επιδεικνύεται εμπράκτως και εφαρμόζεται πολιτική άρνησης αναγνώρισης και εγγραφής ιδιοκτησιών σε μέλη της ΕΕΜ, στις κοινότητες, τις ενορίες και τα μοναστήρια στην ευρύτερη περιοχή της.

Ειδικά εκτεθειμένη η πολιτεία είναι στις συμπράξεις με σκοτεινά συμφέροντα στην παραλιακή ζώνη όπου η ακίνητη περιουσία έχει ιδιαίτερη αξία στην αξιοποίηση της προς οικονομικό όφελος.

Καταγγέλλεται η αδιαφορία κρατικών φορέων εξουσίας, και δη των δικαστικών και εισαγγελικών αρχών να ενεργήσουν σε περιπτώσεις προφανούς παραβίασης της νομοθεσίας τόσο με τη χάλκευσης αποδεικτικών εγγράφων όσο και με κρατικούς λειτουργούς που τα αναγνωρίζουν και εγγράφουν στη συνέχεια αυτά.

Η ΔΕΕΕΜ ΟΜΟΝΟΙΑ διαχρονικά έχει φέρει στην επιφάνεια το ζήτημα, τις αρνητικές του συνέπειες και καλεί και πάλι σε κινητοποίηση αντίστασης όλα τα μέλη και τις κοινότητες της ΕΕΜ. Οι θέσεις της έχουν βρει απήχηση και αντανακλούν στις εκθέσεις της ΕΕ για τις διαδικασίες προσχώρησης της Αλβανίας, σε σχετικές αναφορές του Συμβουλίου της Ευρώπης και επίσης των μηχανισμών των ΗΠΑ.

Τα περίφημα νομοθετήματα που δήθεν προχωρά η Κυβέρνηση όχι απλά δεν προσφέρουν λύση στο πρόβλημα αλλά δημιουργούν επιπλέον δυσκολίες στην αναγνώριση και εγγραφή των ιδιοκτησιών των μελών και φορέων της ΕΕΜ. Η Κυβέρνηση είναι υπεύθυνη διότι διαρκώς κωφεύει στην οξύτητα του προβλήματος συμπράττοντας έτσι στην δια της χρησικτησίας δημιουργία «ιδιοκτήτων». 

Κατόπιν τούτων και ως προτάσεις για αποφάσεις του Γενικού Συμβουλίου της ΔΕΕΕΜ ΟΜΟΝΟΙΑ, η Επιτροπή προτείνει:

-  να συνεχιστεί η παρακολούθηση της υπόθεσης καταγράφοντας όλες τις περιπτώσεις και με έμφαση παραβιάσεις που αποδεδειγμένα αποτελούν καταπατήσεις κατοχυρωμένων ιστορικά περιουσιών των ενοριών, μοναστηριών ή κοινοτήτων

-  εντατικοποίηση της καταγγελίας στους διεθνείς οργανισμούς και ειδικά στην Ευρωπαϊκή Επιτροπή που παρακολουθεί την κατάσταση στο συγκεκριμένο πεδίο υπό το πρίσμα των διαδικασιών εισχώρησης της Αλβανίας

- την διενέργεια ειδικής ερανικής προσπάθειας ώστε να εξασφαλιστούν πόροι για τη συνδρομή των κοινοτήτων και ιδιωτών στις προσφυγές τους ενώπιο της δικαιοσύνης για ακύρωση αδίκων αποφάσεων

-  δημοτικές και κοινοτικές αρχές με την βοήθεια ειδικών ομογενών νομικών που καλούμε να βοηθήσουν επί του θέματος

KOMUNIKATË PËR SHTYP

Çështja: Mbledhje dhe konkluzione të Komisionit të Posaçëm për Mbrojtjen e Pasurisë së Patundshme të Këshillit të Përgjithshëm të BDMEG OMONOIA. Vendosmëri për mobilizim të komuniteteve dhe anëtarësisë së MEG për denoncimin dhe masa për moskrijim precedenti dhe gjendje faktike.

U mblodh dje, e Hënë, 24 Shkurt 2020, në Dervician, nën kryesimin e Kryetarit të Organizatës dhe me pjesëmarrje të Kryetarëve në Degë, Komisioni i Posaçëm për Mbrojtjen e Pasurisë së Paluajtshme të pjesëtarëve dhe komuniteteve të MEG, të Këshillit të Përgjithshëm. Morri pjesë dhe referoi mbi çështjen Kryetari i Partisë Bashkimi për të Drejtat e Njeriut – PBDNJ, z. Vangjel Dule.

Komisioni mori në shqyrtim gjithë parametrat të kësaj çështjeje komplekse, me rëndësi jetike për të tashmen dhe të ardhmen e Minoritetit Etnik Grek. Praktika diakronike të qëllimshme të autoriteteve shtetërore kompetente dhe jo, kanë krijuar një gjendje tejet shqetësuese nga njëra anë duke njohur pronësi me dokumenta të falsifikuara dhe ilegjitime si procedura të tjera manipulimi, në pasuri komunitare ose publike në territore ku historikisht dhe në numra të konsiderueshëm jeton Minoriteti Etnik Grek, autokton.

Për më tepër dhe nga ana tjetër manifestohet praktikisht dhe zbatohet politikë refuzimi në njohjen dhe regjistrimin e pronësive për pjesëtarë, komunitete, enori dhe manastire në rajonin më gjerë.

Veçanërisht i ekspozuar është shteti në bashkëveprime me interesa të errëta në zonën bregdetare ku pasuria e paluajtshme ka vlerë të posaçme në vënien e saj në efiçencë për dobi ekonomike.

Denoncohet ideferenca e enteve shtetërore të pushtetit, në veçanti autoriteteve gjyqësore dhe të prokurorisë publike, në ndërmarrjen e veprimeve për rastet e shkeljes ashiqar të legjislacionit si me fabrikimin manipulativ të shkresave aq edhe ndaj ofiqarëve shtetërorë të në vijim i marrin ato parasysh dhe regjistrojnë pronësi.

BDMEG OMONOIA kohë pas kohe ka sjellë në vëmendje çështjen, pasojat negative të saj dhe thërret përsëri në mobilizim rezistues të gjithë pjesëtarët dhe komunitetet e MEG. Pozicionimet e saj kanë gjetur jehonë dhe reflektohen në raportet e BE-së për procedurat e anëtarësimit të Shqipërisë, në referenca analoge të Këshillit të Evropës dhe gjithashtu të autoriteteve të SHBA-ve.

Projektligje e famshme  të cilat gjoja ndërmerr Qeveria jo thjesht nuk ofrojnë zgjidhje të problemit por krijojnë vështirësi shtesë dhe të komplikuara në njohjen dhe regjistrimin e pasurive të pjesëtarëve dhe enteve të MEG. Qeveria është përgjegjëse sepse vazhdimisht mbetet shurdhmemece ndaj mprehtësisë së problemit duke u bërë bashkëpunuese në këtë mënyrë në krijimin përmes së drejtës së përdorimit të gjoja “pronarëve”.

Pas këtyre dhe si propozime për vendimmarrje të Këshillit të Përgjithshëm të BDMEG OMONOIA, Komisioni propozon:

-  të vijojë ndjekja nga afër e çështjes duke mbajtur shënim të gjitha rastet dhe me theksim në abuzimet ligjore që qartazi përbëjnë cënim të pronësive historikisht të sanksionuara të pasurive të enorive, manastireve apo komuniteteve

-  intensifikim të denoncimit në organizmat ndërkombëtare dhe sidomos Bashkimin Evropian që ndjek situatën në këtë fushë konkrete në optikën e procedurave të integrimit të Shqipërisë

-  realizimin e një fushate të posaçme grumbullimi fondesh në mënyrë që të sigurohen burime për t’u asistuar komuniteteve dhe individëve në procese civile dhe penale në organet e drejtësisë për vendimet e padrejta dhe abuzive

- autoritetet komunitare dhe bashkiake të pushtetit vendor me ndihmën dhe asistencën e juristëve pjesëtarë të MEG thirren të kontribuojnë sipas kompetencave ligjore në këtë çështje

Extraordinary Meeting of the Special Committee on the Protection of Immovable Property of the OMONIA General Council. Decision to mobilize municipalities and the Ethnic Greek Minority with regard to developments on the issue of property rights

The Special Committee on the Protection of Immovable Property of the Ethnic Greek Minority (EGM) Members of the Omonia General Council, chaired by the President of the Organization met on 24 February 2020, in Dervitsani, with the participation of the Heads of the Annexes, as well as of the Chair person of the Party “Union for Human Rights”, Mr. Vangelis Doules.

The Committee took into consideration all aspects of this complex issue, crucial to the future of the EGM. Long standing deliberate practices by State authorities have led to a particularly alarming situation that allows the legalization of properties through the use of forged documents as well as other illegal practices to the detriment of communal and public property in the area where - the indigenous Greek Ethnic Minority historically resides in significant numbers.

Moreover, EGM members as well as its communities, parishes and monasteries are constantly denied the right to legalize and register their property.

Most importantly we underscore the State’s non transparent partnerships in the coastal zone where the land is of significant value for development.

We denounce the reluctance of various authorities, notably of courts and prosecutors to act when the law is blatantly violated, in cases where documents are fabricated as well as the practices of government officials who legalize and register property using fake documents.

Over the years, OMONIA has constantly highlighted the importance of this issue and its negative impact; it therefore calls again on all members and communities of the EGM to mobilize. The positions maintained by OMONIA are echoed by the European Commission Reports on Albania, as well as by documents issued by the Council of Europe and relevant US reports.

The draft law that the Government is currently working on not only does not resolve the problem but causes additional difficulties by legalizing and registering the properties of the members and communities of the EGM. The Government is responsible because it has always turned a blind eye to the problem, thus contributing to the creation of 'owners' through adverse possession.

The Committee proposes the following actions to be adopted by the General Council of OMONIA:

-To continue to monitor closely the situation by recording all cases with an emphasis on violations that constitute encroachments on the historically owned properties of parishes, monasteries or communities of the EGM.

-To denounce this contemptible acts to International Organizations especially to the European Commission that is monitoring the situation in light of Albania's accession process.

-To initiate fundraising so as to secure resources in order to assist communities and individuals who would like to take their cases to court.

-We call on all municipalities and communities to assist us in our just cause with the help of specialized legal counsels.
